1. About These Terms
These Terms of Use govern your use of the Carpeta application, website, and related services (collectively, “Carpeta” or the “Service”).
By downloading, accessing, purchasing, or using Carpeta, you agree to these Terms. If you do not agree with these Terms, you should not use the Service.
2. About Carpeta
Carpeta is an educational organization, note-taking, planning, and study application designed primarily for secondary-school and post-secondary students.
Carpeta may provide tools such as digital binders, handwritten and typed notes, calendars, academic planning, organization features, synchronization features, and optional artificial intelligence (“AI”) study tools.
Features may be added, changed, improved, or removed as Carpeta develops.
3. Account Not Required
Carpeta does not require any student to create an account or profile of any kind. The app has been purposely designed to function without requiring personal information from the user.
Users are responsible for maintaining access to their device and for using available device backup or synchronization features where appropriate.
Because Carpeta does not maintain a traditional account containing a student's identity and educational content, Carpeta's ability to recover content that has been deleted or lost from a user's device may be limited or nonexistent.
4. Student Content
Users retain ownership of the notes, drawings, binder contents, documents, and other educational material they create or import into Carpeta (“User Content”).
Using Carpeta does not transfer ownership of User Content to Carpeta.
You grant Carpeta only the limited rights necessary to process User Content when required to provide a feature that you specifically request. For example, if you ask Carpeta to summarize a note using an AI feature, Carpeta must temporarily process the relevant content in order to generate the requested summary.
This permission applies only to the extent reasonably necessary to provide, operate, and secure the requested functionality. The handling of User Content is further described in the Carpeta Privacy Policy.
5. Responsibility for User Content
Users are responsible for the content they create, import, store, or submit through Carpeta.
You should not use Carpeta to store, submit, or process content that you do not have the legal right to use.
Users should also avoid unnecessarily including highly sensitive personal information in content submitted to AI-powered features.
Carpeta does not routinely review student notes or other User Content.
6. AI-Powered Features
Carpeta may provide optional AI-powered educational features, including features that summarize notes, explain concepts, generate flash cards, create practice questions or tests, assist with studying, or provide other educational assistance.
AI-generated content is produced automatically and may occasionally be inaccurate, incomplete, misleading, outdated, or inappropriate for a particular educational context.
Carpeta does not guarantee the accuracy of AI-generated content. Users should apply their own judgment and, where appropriate, verify important information using course materials, textbooks, instructors, teachers, professors, or other authoritative sources.
AI-generated material should be treated as a study aid rather than as an authoritative source.
7. Academic Integrity
Carpeta is intended to support learning, organization, studying, and understanding.
Users are responsible for complying with the academic integrity policies of their school, college, university, instructor, or other educational institution.
Carpeta should not be used to misrepresent AI-generated work as a student's own work where doing so would violate applicable academic rules.
The availability of a feature within Carpeta does not mean that use of that feature is permitted for every assignment, examination, assessment, or course.
8. OCR and Handwriting Recognition
Carpeta may provide optical character recognition (“OCR”), handwriting recognition, or similar technologies to convert handwritten or visual information into text.
Recognition technologies are not perfect. Generated text may contain transcription errors, omissions, incorrect numbers, incorrect symbols, or other inaccuracies.
Users should review recognized text before relying on it for studying, AI processing, assignments, calculations, or other purposes.
9. Free and Paid Features
Carpeta may provide both free and paid functionality.
Certain features may be made available through a one-time purchase, while other features, including some AI functionality, may require a recurring subscription.
The features included with each purchase or subscription will be described in the App Store or within Carpeta at the time of purchase.
Prices may vary by country or region and may change in the future. Any price change to an existing subscription will be handled in accordance with the rules and requirements of the applicable App Store.
10. Subscriptions
Recurring subscriptions are processed through the Apple App Store or another applicable platform marketplace.
Subscriptions automatically renew unless cancelled in accordance with the terms presented by the applicable marketplace.
Carpeta does not directly process the user's payment card information.
Users can manage or cancel subscriptions through the account settings provided by the marketplace through which the subscription was purchased.
Cancellation prevents future renewals but does not normally terminate access for a subscription period that has already been paid for.
Refunds are governed by the policies of the marketplace through which the purchase was made, except where otherwise required by applicable law.
11. One-Time Purchases
Carpeta may offer features through a one-time in-app purchase.
A one-time purchase provides access to the functionality described at the time of purchase, subject to these Terms and the continued technical availability and compatibility of the Service.
A one-time purchase does not create an ownership interest in Carpeta, its software, or its underlying technology.
12. AI Usage Limits
AI-powered functionality relies on third-party computing resources and operating capacity. Carpeta may therefore apply reasonable usage limits to AI features.
Applicable limits may depend on the user's subscription, the type of AI operation requested, technical capacity, fair-use considerations, or measures necessary to prevent abuse.
Carpeta may temporarily limit or restrict AI requests where reasonably necessary to maintain service reliability, security, availability, or fair use of shared resources.
Carpeta will not intentionally describe a subscription as providing unlimited AI usage where material usage limits apply.
13. Acceptable Use
You may use Carpeta for lawful educational, organizational, personal, and other purposes consistent with the intended operation of the Service.
You may not intentionally:
- interfere with or disrupt Carpeta's servers, systems, or security measures;
- attempt to bypass subscription validation, AI usage limits, or access controls;
- use automated systems to generate excessive or abusive requests;
- reverse engineer Carpeta except where such activity is expressly permitted by applicable law;
- use Carpeta to distribute malicious software or harmful code;
- use the Service for unlawful purposes; or
- attempt to gain unauthorized access to Carpeta's infrastructure or another user's information.
Carpeta may restrict access to online functionality where reasonably necessary to protect Carpeta, its users, infrastructure, or service providers from abuse or security threats.
14. Cloud and Synchronization Services
Carpeta may use operating-system or platform-provided cloud synchronization services to synchronize content between a user's devices.
The availability and operation of these services may depend on the user's device settings, internet connection, cloud storage availability, operating system, and services provided by third parties such as Apple.
Carpeta cannot guarantee that third-party synchronization services will always be available or error-free. Users are encouraged to maintain appropriate backups of important educational material.
15. Service Availability
Carpeta aims to provide a reliable service, but no software or online service can be guaranteed to operate without interruption.
Features that require internet access, AI processing, cloud services, App Store validation, AWS infrastructure, or other third-party services may occasionally be unavailable.
Carpeta may perform maintenance, modify infrastructure, address security issues, or temporarily suspend particular online features when reasonably necessary.
16. Software Updates and Compatibility
Carpeta may be updated from time to time to introduce new features, improve existing functionality, address security issues, correct errors, or maintain compatibility with operating systems and third-party services.
Older versions of Carpeta may eventually become incompatible with certain online functionality.
Carpeta cannot guarantee indefinite compatibility with every device, operating-system version, or third-party service.
17. Intellectual Property
Carpeta, including its software, interface, design, branding, logos, graphics, documentation, and underlying technology, is owned by or licensed to the developer of Carpeta and is protected by applicable intellectual-property laws.
These Terms give you permission to use Carpeta for its intended purposes. They do not transfer ownership of Carpeta or its intellectual property to you.
This section does not apply to User Content, which remains owned by the user or its respective owner.
18. Third-Party Services
Carpeta relies on certain third-party services to provide parts of its functionality, including services provided by Apple and Amazon Web Services.
The operation of those services may be governed by their own terms and policies.
Carpeta is not responsible for outages, changes, or failures caused solely by third-party services outside its reasonable control.
19. Educational Purpose and Disclaimer
Carpeta is an educational productivity and study tool. It is not a school, teacher, tutor, academic institution, or professional educational adviser.
Carpeta does not guarantee improved grades, academic performance, admission to an educational institution, successful completion of a course, or any other particular educational outcome.
Study plans, summaries, explanations, AI responses, OCR results, organizational suggestions, and other content produced by Carpeta are tools intended to assist the user. Users remain responsible for their own academic decisions and work.
20. Disclaimer of Warranties
To the extent permitted by applicable law, Carpeta is provided on an “as is” and “as available” basis.
Carpeta does not warrant that the Service will always be uninterrupted, error-free, completely secure, or compatible with every device or third-party service.
Nothing in these Terms excludes warranties, guarantees, or other rights that cannot legally be excluded under applicable consumer-protection law.
21. Limitation of Liability
To the extent permitted by applicable law, Carpeta and its developer will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of or inability to use the Service.
This includes, without limitation, losses resulting from reliance on AI-generated content, OCR errors, service interruptions, device failures, synchronization failures, or loss of educational content.
Users are responsible for maintaining appropriate copies or backups of important schoolwork and educational material.
Nothing in these Terms limits or excludes liability where doing so would be prohibited by applicable law.
22. Changes to Carpeta
Carpeta will continue to evolve. Features may be added, modified, replaced, or discontinued where reasonably necessary to develop, operate, secure, or maintain the Service.
Where a material change directly affects a paid service, Carpeta will take reasonable steps to communicate the change where appropriate.
23. Changes to These Terms
These Terms may be updated from time to time to reflect changes to Carpeta, its services, applicable laws, or business practices.
When material changes are made, the “Last Updated” date will be revised and notice may be provided within the app where appropriate.
Continued use of Carpeta after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
24. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Nothing in these Terms prevents a consumer from relying on mandatory rights or protections provided by the laws applicable to them.
25. Apple App Store
If Carpeta is downloaded through the Apple App Store, you acknowledge that these Terms are between you and the developer of Carpeta, not Apple.
Apple is not responsible for providing maintenance or support for Carpeta except as required by applicable law or the terms of the App Store.
Your use of Carpeta must also comply with the applicable Apple Media Services Terms and Conditions and App Store rules.
To the extent required by Apple's applicable terms, Apple and its subsidiaries may be third-party beneficiaries of these Terms in relation to your use of the iOS or iPadOS version of Carpeta.
26. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
27. Entire Agreement
These Terms, together with the Carpeta Privacy Policy and any additional terms presented in connection with a specific paid feature or service, constitute the agreement governing your use of Carpeta.
